These Terms of Service ("Terms") govern your access to and use of the Kartoonify mobile application for iOS and Android (the "App"), provided by Pocket AI Labs ("Pocket AI Labs", "we", "us", or "our").

By downloading, installing, accessing, or using the App, you ("you" or "User") acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not install or use the App. If you have already installed it, uninstall it and stop using it.

1. Summary (Plain-Language Highlights)

This summary is for convenience only and is not legally binding. If it conflicts with the rest of these Terms, the rest of these Terms control.

2. Eligibility

2.1 Age and Capacity

You must be at least the age of majority in your jurisdiction, or at least 13 years old with the consent and supervision of a parent or legal guardian where permitted by applicable law and by the rules of the app store from which you obtained the App. By using the App, you represent that you meet these requirements and have the legal capacity to agree to these Terms.

2.2 No Account Required

The App does not require you to create an account, register, or provide personal information to Pocket AI Labs in order to use it. Your settings and preferences are stored locally on your device.

3. Nature of the Service — On-Device Processing

3.1 All Image Processing Is Local

Kartoonify performs all image processing on your device. This includes, without limitation:

• Camera capture and photo library import;
• Image preprocessing, resizing, and enhancement;
• Face detection, face alignment, face embedding, and face swap operations;
• Low-light correction, super-resolution, and other enhancement steps;
• Style transfer and cartoon/anime generation using on-device AI models;
• Rendering, previewing, and saving of results.

All AI models used for these operations are bundled with the App or stored on your device, and inference runs on your device's own CPU, GPU, or neural processing hardware.

3.2 We Do Not Send Your Images Anywhere

Pocket AI Labs does not send your source images, intermediate images, generated images, face data, or biometric-derived data off your device for processing or for any other purpose. We do not operate any cloud image-processing service, and we have no ability to access, view, or recover the images you process in the App.

3.3 Limited Network Use

The App's network activity is limited to:

1. Analytics and crash reporting as described in Section 4 (no image content is transmitted);
2. App updates and purchases handled by the Apple App Store or Google Play, governed by those platforms' own terms;
3. Any transmission you explicitly initiate yourself, such as sharing a result through the system share sheet to another app or service of your choosing (see Section 6).

3.4 No Cloud, No Sync, No Backup

The App does not provide cloud storage, synchronization, remote backup, or account-based recovery for your images. If an image of yours appears anywhere other than your device, it is because you placed it there — for example, by saving it to a cloud-synced photo library or sharing it with another app, service, or person.

4. Analytics and Diagnostics

4.1 What We Collect

The App collects basic analytics and crash diagnostics to help us understand app usage, measure reliability, and fix defects. This may include:

• App lifecycle events (for example, app startup and app-ready events);
• Feature and screen usage events, and counts of operations performed;
• Performance metrics such as processing duration and success or failure of an operation;
• Device and environment information such as device model, device performance tier, operating system version, app version, and locale;
• Crash reports, error messages, stack traces, and technical diagnostic data, including crashes of native components and background processing engines.

4.2 What We Do Not Collect

Analytics and crash data do not include your photos, camera frames, generated images, face images, face embeddings, or the content of any image you process. We do not collect your name, email address, phone number, or contacts.

4.3 Third-Party Analytics Providers

Analytics and crash reporting are provided using third-party services (including Google Firebase Analytics and Firebase Crashlytics). Data collected through these services is processed by the relevant provider under that provider's own terms and privacy policy. Your app store platform may also collect its own metrics independently of us.

4.4 Privacy Policy

Our collection and handling of analytics and diagnostic data is described more fully in our Privacy Policy, which is incorporated into these Terms by reference. Analytics and crash reporting operate as part of the App's normal functioning; the App does not provide an in-app setting to disable them. If you do not wish this data to be collected, do not use the App. Your device's operating-system privacy controls may allow you to limit some collection.

5. Your Images — Ownership and Responsibility

5.1 You Own Your Content

You retain all right, title, and interest in the photos you capture or import, the images the App generates from them, and any derivatives of those images (collectively, "Your Content"). Pocket AI Labs claims no ownership over Your Content and acquires no licence to it.

5.2 You Are Solely Responsible for Your Content

Because all processing and storage occur on your device, you assume all responsibility for Your Content, including:

• Rights and permissions. You must have all necessary rights, consents, and permissions for every photo you process — including the consent of every identifiable person appearing in it, and any rights required by copyright, publicity, or data-protection law. This is especially important for face swap and face-related features, which involve the likeness of real people and may involve biometric data regulated in your jurisdiction.
• Storage and backup. The App does not back up Your Content. You are responsible for maintaining your own backups.
• Device security. You are responsible for securing your device with a passcode, biometric lock, and device encryption as appropriate.
• Legal compliance. You are responsible for complying with all laws applicable to the images you create, store, and share.

5.3 No Custody, No Recovery

Pocket AI Labs never holds, hosts, or controls Your Content. Because Your Content exists only on your device (and wherever you have chosen to put it), loss of your device, deletion of the App, an operating system reset, storage corruption, or accidental deletion may result in permanent, unrecoverable loss of Your Content. Pocket AI Labs cannot recover it and is not responsible for any such loss.

6. Saving and Sharing — Your Sole Responsibility

6.1 Sharing Features Are Provided for Your Convenience

The App includes features that let you save results to your device photo library or send them to other apps, people, or services using your device's share functionality.

6.2 Pocket AI Labs Accepts No Responsibility for Shared Images

Once an image leaves the App — by being saved to your photo library, exported, shared, messaged, posted, uploaded, or transmitted in any way — it is entirely outside Pocket AI Labs' control. To the maximum extent permitted by law, Pocket AI Labs accepts no responsibility and no liability whatsoever for:

• Any loss, deletion, corruption, or unavailability of an image after it leaves the App;
• Any disclosure, interception, leak, or unauthorised access to a shared image;
• Any republication, redistribution, alteration, monetisation, or misuse of a shared image by any third party;
• The privacy practices, security, terms, or conduct of any third-party app, platform, network, or recipient you choose to send images to;
• Any consequence — personal, reputational, legal, financial, or otherwise — arising from your decision to share an image.

The decision to share is yours alone, and the risk of sharing is yours alone.

7. Acceptable Use

You agree not to use the App to create, process, or distribute any image that:

• Depicts a person without their consent in a manner that is deceptive, defamatory, harassing, or harmful;
• Constitutes non-consensual intimate imagery, sexual content involving minors, or any other unlawful content;
• Impersonates a real person or is presented as authentic when it is synthetically generated or altered, in a way intended to deceive;
• Infringes any copyright, trademark, privacy, publicity, or other right of any person;
• Violates any applicable law, regulation, or third-party terms, including the rules of the Apple App Store or Google Play.

You further agree not to reverse engineer, decompile, disassemble, extract models or assets from, tamper with, or attempt to circumvent any technical measure in the App, except to the extent such restriction is prohibited by applicable law.

We may cease providing the App, or updates to it, to any user who breaches this Section.

8. AI Output — No Guarantee of Accuracy or Suitability

The App uses generative and transformational AI models. Output is synthetic and approximate. Pocket AI Labs makes no representation that any output will be accurate, flattering, appropriate, consistent, free of artefacts, or suitable for any particular purpose. Output may vary across devices, images, and app versions. You are responsible for reviewing all output before using or sharing it.

9. Intellectual Property and Third-Party Components

9.1 The App

The App, including its software, design, branding, and bundled models and assets, is owned by Pocket AI Labs or its licensors and is protected by intellectual property law. Subject to these Terms, Pocket AI Labs grants you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own use.

9.2 Third-Party and Open-Source Components

The App incorporates third-party and open-source software, AI models, and libraries, each licensed under its own terms. Those terms govern your use of those components and, where they conflict with these Terms with respect to that component, those terms control. Attribution and licence notices are made available within the App or its documentation.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND. To the maximum extent permitted by law, Pocket AI Labs disclaims all warranties, express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. Pocket AI Labs does not warrant that the App will be uninterrupted, error-free, secure, compatible with your device, or that defects will be corrected.

Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, the above exclusions apply only to the extent permitted, and you may have additional statutory rights that these Terms do not affect.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POCKET AI LABS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, IMAGES, PROFITS, GOODWILL, REPUTATION, OR PRIVACY, arising out of or relating to the App or these Terms, whether based in contract, tort (including negligence), strict liability, or any other theory, and whether or not Pocket AI Labs has been advised of the possibility of such damages.

Without limiting the foregoing, Pocket AI Labs is not liable for any loss of, damage to, or exposure of image data, including image data lost from your device and image data you have chosen to share, export, or transmit.

Pocket AI Labs takes no responsibility for any damage to your device or hardware — including overheating, battery degradation, reduced battery life, or any other hardware failure — arising from prolonged or excessive use of the App on your phone. On-device AI inference is computationally intensive; you are responsible for using the App in a manner consistent with your device manufacturer's guidance and for monitoring your device's condition during use.

To the maximum extent permitted by law, Pocket AI Labs' total aggregate liability arising out of or relating to the App or these Terms will not exceed the greater of (a) the total amount you paid Pocket AI Labs for the App in the twelve (12) months preceding the event giving rise to the claim, or (b) ten US dollars (US$10.00).

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, or for death or personal injury caused by negligence.

12. Assumption of Risk and Indemnity

12.1 You Assume All Risk

If you choose to use the App, you do so at your own risk and you accept all responsibilities and consequences arising from that use, including your handling, storage, and sharing of images and your compliance with all applicable law.

12.2 Indemnity

You agree to indemnify, defend, and hold harmless Pocket AI Labs and its officers, directors, employees, contractors, and agents from and against any claim, demand, loss, liability, damage, cost, or expense (including reasonable legal fees) arising out of or relating to (a) your use of the App, (b) Your Content, (c) your saving, exporting, or sharing of any image, (d) your breach of these Terms, or (e) your violation of any law or of the rights of any third party.

13. Platform Terms

The App is distributed through the Apple App Store and Google Play. Your use of the App is also subject to those platforms' terms. Apple and Google are not parties to these Terms and have no responsibility for the App. The Apple App Store terms' "Licensed Application End User License Agreement" provisions apply to iOS users to the extent required by Apple, and Apple and its subsidiaries are third-party beneficiaries of these Terms with the right to enforce them against you.

14. Changes to the App and to These Terms

We may modify, suspend, or discontinue the App or any feature at any time, with or without notice. We may also update these Terms; the "Last updated" date above indicates the most recent revision. Material changes will be communicated through the App or the app store listing where reasonably practicable. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms. If you do not accept them, stop using the App and uninstall it.

15. Termination

These Terms apply for as long as you use the App. You may terminate them at any time by uninstalling the App. Sections 5, 6, 8, 10, 11, 12, 16, and 17 survive termination.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. The state and federal courts located in the State of Delaware will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the App, except that either party may seek injunctive relief in any court of competent jurisdiction. If you are a consumer, this Section does not deprive you of the protection of mandatory consumer-protection laws of your country of residence.

17. General

• Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Pocket AI Labs regarding the App.
• Severability. If any provision is held unenforceable, the remaining provisions remain in full force, and the unenforceable provision will be enforced to the maximum extent permitted.
• No waiver. Failure to enforce any provision is not a waiver of it.
• Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
• Language. These Terms are drafted in English; any translation is provided for convenience only.
